After hearing the parties for sometime, as the Court was not inclined to interfere in the impugned order, the learned counsel for the petitioner No.3 upon instructions seeks leave to withdraw the petition with liberty to file a counter claim in the suit filed by the respondent No.3, which is pending in the Court to agitate the 1/2

Shantanu Dhudum 902-WP-8382-2024.doc grievance raised in this petition. The statement is accepted. The petition is dismissed as withdraw with liberty as prayed for. 2.

Learned counsel for petitioner No.3 also raises an apprehension that respondent No.3 and all its members are liable to dispossess the petitioner from the premises occupied by him. Learned Senior Counsel for respondent No.3 upon instructions makes a statement that the apprehension is misconceived, as the respondent No.3 or its member do not have any intention to dispossess the petitioner from the area occupied by him. The statement is accepted as statement to the Court.
