The prayer made in the present writ petition is for consideration of the petitioner's application dated 29th November 2023 and 26th March 2024 seeking benefit of the One Time Settlement Scheme. In the reply filed on behalf of the respondent no.1-bank, it has been stated that the petitioner failed to comply with the requirements of the One Time Settlement Scheme by depositing the requisite amount for its consideration. 2.
In the light of the law laid down by the Supreme Court in Bijnor Urban Cooperative Bank Limited Bijnor and Others Vs. Meenal Agarwal and Others, (2023) 2 SCC 805 and especially paragraph 6 of the same, we do not find that any direction can be issued to the respondent-bank to accept the petitioner's proposal. 1/2
43-WP-8439-24.doc Rameshwar Dilwale In that view of the matter, we are not inclined to entertain the writ petition. The petitioner is at liberty to pursue other legal remedy. The Writ Petition is disposed of.
