By the present Writ Petition filed under Article 227 of the Constitution of India, the challenge is to the legality and validity of the order dated 20th April, 2024 passed by the Principal Judge, Family Court, Mumbai below Exhibit 13 in Petition No. A-2137 of 2021 ("Impugned Order").

By the Impugned Order, the Petitioner is directed to pay Rs. 50,000/- per month to the Respondent towards child's maintenance. Learned Principal Judge of the Family Court has recorded that the 6th February, 2026 Shraddha
31-WP-8452-2024.doc income of the wife is about Rs. 45,000/- and salary of the Petitionerhusband is Rs.2,88,500,/-, and therefore, granted the maintenance to the child. The Learned Principal Judge specifically recorded that the maintenance is only to the child and prayer of the Respondent-wife seeking maintenance has been rejected.

It is the submission of Ms. Murgude, Learned Counsel for the Petitioner that the Petitioner is paying EMI of the flat at Thakur Village, Kandivali (East) as also the Petitioner has also to look after his parents. However, perusal of the record shows that the Petitioner's father has retired from BMC and mother has retired from ESIC, and both are getting pension. Thus, in the facts and circumstances, no interference in the Impugned Order dated 20th April, 2022 is warranted. 5.
