By this petition, the challenge is to the order of Appellate Authority passed under the provisions of the Maintenance and Welfare of Parents and Senior Citizens Act, 2007.
3.
Admittedly, the premises stand in the name of the Respondent No. 2 and she had approached the Competent Authority constituted under the provisions of the Maintenance and Welfare of Parents and Senior Citizens Act, 2007 making specific allegations as regards the harassment at the hands of Petitioners. The Competent Authority has assessed the pleadings and after hearing parties passed the order directing the Petitioner to hand over the peaceful possession of Patil-SR 1 of
905 Wp-8453-2024.doc premises and not to enter the said premises. Admittedly, the order dated 1st January 2024 directing delivery of vacant possession has already been complied with and the premises has been handed over on 14th June 2024.
4.
Considering that the impugned has already been executed and it is not disputed that the Respondent No.2 is the owner of the subject premises, nothing survives for consideration in the present Petition. Petition is disposed of.
5.
It is open for the parties to take out appropriate civil proceedings, in case any right is claimed in the premises. [Sharmila U. Deshmukh, J.] Patil-SR 2 of Signed by: Sachin R. Patil Designation: PS To Honourable Judge Date: 17/12/2024 19:04:40
