The contention is that as the petitioners are Police Patil, and are paid honorarium for working as such, the same would not fall in group A, B, C, & D posts in Government Department on account of which the Maharashtra Civil Services (Declaration of Small Family) Rules, 2005 would not be applicable. The AGP to file an affidavit indicating as to whether the appointment of the petitioners falls in group A, B, C, & D, to which the aforesaid Rules are applicable.
