The controversy is that though the order by the Senior Citizen Welfare Tribunal, directs delivery of possession of House No. 326 D, Chamur Lane, Warin Pada, Khar Danda, Khar (West), Mumbai 400 052, the authorities, under the Order dated ARUN RAMCHANDRA SANKPAL 09.01.2024 (page 104) have instead taken possession of a ARUN RAMCHANDRA SANKPAL Date: 2024.07.18 19:49:55 +0530 different property bearing No. 326.

The learned counsel for petitioners in order to substantiate this contention, seeks to place reliance upon the ration card and Arun Sankpal
4-wp-8620-2024.doc the electric meter bill, which in my considered opinion would not be sufficient to determine that the above properties are different and distinct.

The learned counsel for petitioners therefore, to place on record, the documents indicating that House No. 326 and 326-D are two different and distinct properties.

The learned counsel for the respondents upon instructions submits, the respondents shall open the lock which according to them have been affixed on property House No. 326 D, so as to enable the petitioners, to take away their belongings. The same shall be done on 20.07.2024 at 10.00 am in the presence of the learned counsel of the parties. The respondents, after the belongings are taken out, shall re-affixed their lock to the premises, which they claim to be House No. 326-D. 5.
List the matter on 25.7.2024, to enable the learned counsel for the petitioners to place on record the documents relating to distinct identity of the aforesaid properties. (AVINASH G. GHAROTE, J.) Arun Sankpal
