Mr. Ramdas Sabban, learned counsel for the petitioner has made a statement that the possession of the land subject matter of acquisition was already taken and handed over to the National Highway Authority. His contention is that the highway/road has already been constructed on the petitioner's land, which is popularly known as the "Palkhi Highway". Mr. Samant, learned Addl. Government Pleader has drawn our attention to the reply affidavit filed to the petition stating that possession of the land is still with the petitioner, except in the case of Ranjana Mahandev Kumbhar, the petitioner in Writ Petition No. 8634 of 2024, the possession of whose land is with the National Highways Authority. 2.

Let this factual position be clarified by an affidavit to be filed on behalf of the petitioner, as to whether the petitioner disputes that the possession is not with the petitioner and has already been handed over, with supporting material. Let this be done within one week from today. List these matters on 23 August, 2024, High on Board.
