CIVIL APPELLATE JURISDICTION WRIT PETITION NO. 8706 OF 2024 Jatin Sunil Rajusth ... Petitioner vs.
Vidhi Jatin Rausth ... Respondent None for the Petitioner.
CORAM : GAURI GODSE, J.
DATED : 3rd JULY 2024 ORDER:
1.
On 24th June 2024, following order was passed:- "1.
This petition is circulated for withdrawal of the writ petition.
2.
Perusal of the papers indicates that by order dated 12th April 2024, this Court had directed the petitioner to deposit the entire arrears of interim maintenance before the Family Court within three weeks from the date of order. Subject to such deposit, notice was issued to the respondent.
3.
When a query was put to the learned counsel appearing for the petitioner, whether the directions issued by this Court on 12th April 2024 are complied with, learned counsel is unable to make any statement. To enable the learned counsel for the petitioner to take instructions, whether the directions issued by this Court on 12th April Page no. 1 of 2

4.
Though specific directions were issued by this Court for depositing arrears towards maintenance and notice was issued to the respondent, the learned advocate for the petitioner has not supplied copies. Hence, notice was not issued as recorded in the office note. On the last occasion, the petition was moved for withdrawal. However, the petitioner had sought time to take instructions whether the directions issued by this Court on 12th April 2024 are complied with.
5.
Today, none appears for the petitioner. The petitioner has thus failed to comply with the directions issued by this Court. Hence, the office is directed to issue notice to the petitioner to show cause as to why action should not be initiated for non-compliance of the directions issued on 12th April 2024. Notice is made returnable on 9th August 2024.
6.
It is clarified that the notice not to be construed as notice under Rule 9 of Contempt of Courts(Bombay High Court) Rules, 1994.
