Prima facie it appears that dispute under section 91 after initiation of proceedings under section 101 of the Maharashtra Cooperative Societies Act, 1960 is not maintainable in view of Division Bench judgment of this Court in Basaveshwar Cooperative Credit Society Ltd., Kolhapur vs. Jayant Shivlal Banchhode reported in 2009 (2) Mh.L.J. 216. Hence, there shall be ad-interim relief in terms of prayer clause (b).
