The case of the petitioners is that of the land acquired for an irrigation project of a dam and compensation not being paid to the petitioners. It is contended that repeated attempts made to acquire the land have failed, inasmuch as the notification which was issued to acquire the land was not taken into the logical conclusion. 3.

Mr. Reddy, learned counsel for the petitioners, submits that the issue would stand squarely covered by the judgment of the Supreme Court in Sukh Dutt Ratra & Another vs. State of Himachal Pradesh & Ors.1 and the decision of this Court in Sumitra Shridhar Khane vs. Deputy Collector & Ors.2.

Ms. Kapadia, learned counsel for respondents would take instructions and place on record a short reply affidavit.

We shall hear the parties on the adjourned date of hearing and make an endeavour to dispose of this petition finally.
