After arguing for some time, Mr. Mundhe, learned counsel for the petitioners would submit that the petition be disposed of by directing the learned Trial Court to conclude the trial within a time bound manner. Both learned counsel for the respective parties would submit that the trial has reached the stage of evidence and both are desirous to conclude the trial proceedings as early as possible. 2.

The learned counsel for the respective parties undertakes that none of them would seek unnecessary adjournments in the matter and would not protract the suit proceedings either way. The statements made by the learned counsel for the respective parties are accepted as undertakings to this Court.

The writ petition stands disposed of accordingly with a request to the learned Trial Court to make every endeavour to conclude the trial within an outer limit of 12 Months from today. 4.

Needless to mention, the findings of the learned Trial Court, as also of the learned District Court while deciding the application of the plaintiff under Order XXXIX Rules 1 and 2 read with Section 151 of the Code of Civil Procedure, 1908, shall not influence the trial.

With these observations, the writ petition stand disposed of.
