At the outset, learned AGP raises a preliminary objection. He submits that the Petition is not maintainable since the Petitioner has an alternate efficacious remedy to file an appropriate Application before the Charity Commissioner/appropriate authority, seeking the same reliefs as sought for in the Petition.

In view of the preliminary objection raised by the learned AGP, learned counsel for the Petitioner seeks leave to withdraw the Petition with liberty to adopt appropriate remedy before the appropriate authority/Forum.

The Petition is accordingly disposed of with liberty as prayed for.

We make it clear, that we have not gone into the merits of the Petition and as such, keep all contentions of all the parties on merits open.
