Heard learned counsel for the petitioners and learned AGP for respondent/State.

The petitioners have suffered an order under Section 14 of 'The Secularisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 (for short ' the Act of 2002') passed by the learned District Magistrate, Aurangabad they therefore, filed Securitisation Application No. 134 of 2023 before the learned Presiding Officer of the Debts Recovery Tribunal, Aurangabad (for short 'DRT') challenging the same.

By an order dated 04.05.2023, the application seeking interim relief has been turned down by the DRT and as such, the petitioners are before this Court.

I find that the order passed by the DRT is appealable under

2 919.doc Section 18 of the Act of, 2002 and as such, the Writ Petition is not maintainable.

The petitioners are at liberty to file appeal as stated above before the Debts Recovery Appellate Tribunal (for short 'DRAT'). 5.

Needless to state that, the time consumed in prosecuting this Writ Petition shall be taken into consideration while deciding the application seeking condonation of delay.
