In the present writ petition a challenge was raised to the notice dated 17th May, 2024 that was issued by the Deputy Registrar under Section 75(5) of the Maharashtra Co-operative Societies Act, 1960. While entertaining the writ petition, the Court on 11th July, 2024 called upon the learned Assistant Government Pleader to indicate the steps taken pursuant to the aforesaid notice. On the next date, it was informed that on 30th
KVM 2/2 911 - WP 9057 OF 2024.doc August 2024 an order under Section 75(5) of the said Act has been passed. By that order, the petitioners who are the members of the Managing Committee have been removed for a period of one year.

Having heard the petitioner no.1 in person who is, also representing the other petitioners, we find that there is an alternate statutory remedy for challenging the order passed on 30th August 2024 under Section 75(5) of the said Act. In that view of the matter, we are not inclined to entertain the challenge to that order on merits. Keeping all points raised on merit open and with liberty to the petitioners to avail the statutory remedy, the writ petition is disposed of.
