CORAM : NITIN JAMDAR & M. M. SATHAYE, JJ.

DATED : 12 AUGUST 2024 P.C.:

1.

We have perused the mediation report. The learned Mediator has recorded that initially the Respondent-Management had shown positive approach and therefore the mediation was adjourned on four occasions. Thereafter, the Respondent - Management took a non-cooperative stand that the Secretary is not available and therefore the Mediator has recorded that the mediation has failed.

2.

The Petitioners have sought monetary reliefs from the RespondentManagement. If the relief as sought for by the Petitioners is granted, there would be a financial burden on the Respondent-Management and therefore, the mediation was proposed to work out installments, if any. However, in view of the fact that the Respondent-Management had shown no interest in the mediation, the Petitions will have to be worked out on merits. If the Petitioners do not succeed, there will not be any monetary liability. If they succeed, considering the conduct of the Respondent-Management that despite there being an opportunity, has not given any offer of settlement, the Court may consider refusing to grant any installments.

3.

Reply of the Respondents to be filed before the next date. The Respondents may choose to file reply in one of the Petitions and adopt 4/5

the same in other Petitions by way of praecipe. Reply of the State Government also to be filed before the next date. 4.

Learned Counsel for the Respondent-Dr. Babasaheb Ambedkar Technological University states that the Vakalatnama and reply will be filed in the Petitions where it has remained to be filed. Learned Counsel for the Respondent-AICTE states that reply will be filed in one Petition and the same would be adopted in other Petitions unless separate reply is required.

5.

Writ Petition No. 5681 of 2024 is taken as lead Petition in this group where all the replies and rejoinders are to be filed. 6.

Stand over to 27 August 2024.

7.

Learned Counsels for the parties states that Writ Petition No. 9461 of 2024 and Writ Petition No 9286 of 2024 are wrongly tagged. They be separated and listed as per the assignment.
