1] Heard the learned counsel for the petitioner. The learned counsel for the petitioner submits that liberty be granted to the petitioner to file fresh application before the trial Court as the application for withdrawal of the suit on the same cause of action has been rejected by the trial Court on account of the fact that sufficient grounds were not pleaded by the petitioner in the application and he would plead necessary facts in the suit in accordance with law.

2] Issue notice to the respondents, returnable on 01.10.024.

3] Notice shall indicate that the petitioner will be disposed of on the returnable date.
