By the present Writ Petition filed under Article 227 of the Constitution of India, the challenge is to the legality and validity of order dated 13th December 2023 passed by the learned Judge, Family Court, Thane below Exhibit-18 in Petition No.A-223 of 2022. By the said order, Application filed by the Petitioner-Wife for Sonali

921-WP-9481-2024.DOC interim custody of her son has been rejected and order regarding access of the son has been granted.

It is the main contention of the Petitioner that on 31st March 2022, the Respondent-Husband came to the Petitioner-Wife's house and took the child forcibly against the will of the child and without informing the Petitioner-Wife when the Petitioner-Wife was at her work place.
