Heard learned counsel for the petitioner. It is submitted that the project cost of the petitioner is reduced arbitrarily only on the basis of the report received from the Executive Engineer of respondent no. 4. It is submitted that respondent no.4 - Maharashtra State Co-operative Textile Federation Limited as well as Deputy Commissioner attached to the office of the Commissioner submitted a report justifying the need of the petitioner for the revised project cost of Rs. 77.03 Crores. It is
Ingale 15-wp-9501-24.odt submitted that these two reports have not been considered in the proper perspective and undue excessive reliance is placed on the Executive Engineer's report. Learned counsel for the petitioner submitted that the petitioner may be permitted to make a fresh representation to the respondent no. 3 bringing on record all these facts.

Learned AGP invited our attention to the affidavit in reply filed on behalf of the respondent no. 1. It is submitted that respondent no.3 is justified in stating the project cost at Rs.69.21 Crores. In the facts and circumstances of the present case, we request the respondent no.3 to re-examine the representation if made and take the same to its logical conclusion in accordance with law. We are not expressing any opinion on merits of the case. If such a representation is made, the same be decided within a period of 6 weeks from the date of its receipt.
