The matter can be disposed of in view of the consensus arrived at between the parties that as no opportunity for advancing final arguments were given to the Petitioner, the matter can be remanded to the Estate Officer for final arguments by quashing the impugned Judgment.

Learned Counsel appearing for the Respondent has placed on record the email instructing the Advocate for agreement that the matter be remanded back for final submissions within a fixed time period. The email is taken on record.

In light of the above, as the parties agreed that there was no opportunity for advancing final arguments given to the Petitioner the impugned order dated 1st June 2024, is quashed and set aside with Shubham Talle 1 of

The Case No. EO/PPE & R/9 of 2012 is remanded to the file of the Estate Officer to be considered afresh after hearing the final arguments.
