By the present petition, the challenge is to order arising out of issuance of Recovery Certificate.

Learned counsel for Petitioner, on instructions, submits that subsequently the matter had been settled with Respondent No.2-Path Sanstha and 'No Dues Certificate' has been obtained. The copy of 'No Dues Certificate' is tendered by Path Sanstha and the same is taken on record. He seeks permission to withdraw the petition with liberty to adopt proceedings for recovery of excess amount which according to him was paid to Respondent No.2-Path Sanstha. Petition is permitted to be withdrawn.

It is open for the petitioner to inititate proceedings for recovery of stated excess amount, if permissible under law. Sairaj 1 of
