Mr..Surana, the learned counsel for respondent No.3, upon instructions makes a statement that respondent No.3 is not in a VAI

914-WP-9685-2024.doc position to deposit the amount of Rs.1,58,50,000/- on account of arrears of rent payable to the eligible slum dwellers under the Agreement of Development dated 09.06.2015 and LOI dated 28.09.2018, as undertaken by him, which is recorded in the order dated 11.07.2024.

In that light of the statement, the order dated 07.06.2024, passed by the respondent No.1 , is not sustainable, and is accordingly set aside. The petition is accordingly allowed in aforesaid terms. No costs.
