1] The learned counsel for the petitioners submits that on the date of impugned order, the plaintiffs have not led evidence. He further submits that the impugned order passed by the trial Court, appointing the Court Commissioner amount to collection of evidence in favour of the plaintiffs and is erroneous.

2] Issue notice to the respondents, returnable on 18.10.2024.

3] Till the next date, the impugned order dated 11.06.2024 passed by the 4th Joint Civil Judge Junior Division, Osmanabad below Exh.20 in RCS No.697/2021 is stayed.
