Mr. Akshay Deshmukh, learned counsel appears for the Petitioners and submits that the matter is settled before the trial Court. He produces the order whereby the suit itself is dismissed as withdrawn unconditionally. The same is taken on record and marked "X' for identification. Two of the Plaintiffs are present in the Court.

Ms. Poonam Madhwani, learned counsel appears and submits that she had filed Vakalatnama on behalf of the Plaintiffs and she has not given no objections. Learned counsel submits that she appeared for the plaintiffs before the Small Causes Court so also before the High Court, however, no objection is not taken from her. From the Order, it is apparent that the matter was referred for mediation and the mediation settlement report is received from the Mediator and based on the same, the order is passed on the civil suit, which is being dismissed. Considering that the suit itself is dismissed as withdrawn, and the proceedings arising therefrom, the present Petition cannot be continued and is dismissed accordingly.
