Prima facie it appears that the Trial Court proceeded casting burden on the plaintiff to prove the nature of suit property being joint family property. However, at the stage of arguments, the issue was recasted by the impugned order casting burden to prove on the defendant. Hence, issue notice to respondent No.1, returnable on 2 September 2024.

Till the next date, there shall be ad-interim relief in terms of prayer clause (b).
