Even though the grievance of the Petitioner is that the order is passed by the Divisional Commissioner, Konkan Division, Navi Mumbai dated 26 March 2024 is not complied with, the document dated 26 March 2024 is not an order creating right in favour of the Petitioners but it is a proposal submitted by the Divisional Commissioner to the Secretary Rural Development Department recommending transfers of around 10 employees including the Petitioners.

The proposal is pending before the State Government. This proposal was sent to the State Government on 26 March 2024 and within three months this writ petition is filed. The proposal will have to be decided by the State Government as per its procedure. There would be several such applications pending before the State Government and they would be processed as per law.
