Heard the learned counsel appearing for the Petitioner. Issue notice to Respondent, returnable on 19 August 2024. Perusal of the order passed by this Court on 25 July 2023 in Writ Petition No.6834 of 2022 would indicate that the only the aspect of legality and proportionality of the punishment was left to be decided by this Court. Prima facie it appears that the charge levelled and proved against the Respondent relates to misappropriation and is of serious nature. Without katkam Page No.

Prima facie therefore the order passed by the Industrial Court appears to be erroneous. In that view of the matter, the order dated 3 July 2024 passed by Member, Industrial Court shall remain suspended till the next date of hearing. (SANDEEP V.
