The learned counsel for the petitioners seeks leave to withdraw the petition on account of remedy of Appeal available to the aggrieved person under Section 16 of The Maintenance And Welfare Of Parents And Senior Citizens Act, 2007. The learned Division Bench of Aurangabad Bench this Court in case of Jagdish Pitamber Pawar vs. Pitamber Pundlik Pawar & Ors. in Writ Petition No.36 of 2023, has held, that an appeal by the aggrieved party under Section 16 of The Maintenance And Welfare Of Parents And Senior Citizens Act, VAI

910-WP-9983-2024.doc 2007 is maintainable and seeks protection from eviction for a period of one week from today.

Accepting the statement, the petition is dismissed as withdrawn with liberty to approach the Appellate Authority under Section 16 of The Maintenance And Welfare Of Parents And Senior Citizens Act, 2007. The impugned order dated 14.06.2024 shall not be executed for a period of one week from today.
