In this Petition, the Petitioner, inter-alia, has assailed the validity of the impugned E-Tender Notice No. 02/2024-25 dated 12th February 2024, for collection, transfer and transportation of the Municipal Solid Waste within their territorial limits.

During the pendency of the Petition, admittedly, in pursuance of the notice inviting tender, the work order has been issued in favour of the successful bidder viz. Konark Infrastructure Pvt.Ltd. On 28th January 2025 and on 11th February 2025 also time was given to the Petitioner to implead 1/2
JPP 24. WP 10035.24.doc the successful bidder. However, the Petitioner has not impleaded the successful bidder.

It is also pertinent to note that the Petitioner has not participated in the current tender and therefore, does not have any locus to challenge the Award of contract in favour of the third party. [See Nilesh Suresh Kshatriya vs. State of Maharashtra (2023(2) Mh.L.J. 63 )]. 4.
For the aforementioned reasons, we do not find any merit in the Writ Petition. The same is accordingly dismissed. ( BHARATI DANGRE, J. ) ( CHIEF JUSTICE ) 2/2
