A praecipe is moved on behalf of Respondents seeking circulation of writ petition under stamp number. It is true that this Court has issued a Circular informing listing of the matter only when regular number is given but when the petition remains on a stamp number for long period, certainly Court can allow the praecipe and list the matter on Board and in fact this Court as per the order dated 12 September 2024 has directed to defer the hearing of the suit until both the petitions are heard.

In this petition, the Petitioner who is defendant had challenged the order refusing permission to file amended written-statement. It
