Heard, the learned counsel for the petitioners. The petitions question the order dated 27.05.2024 passed by the Assistant Charity Commissioner, Greater Mumbai, by which the application of the respondent No.1 for impleading as the party opponent in the Change Report Enquriy No.4588/2012 and connected change reports, out of which these petitions arise filed by the petitioners has been allowed. The learned counsel for the petitioners submits, that the respondent No.2, was neither the member of the petitioner Trust, nor concerned with its affairs, except for the fact that at one point of time, he was employed by the School run by the petitioner Trust and had been terminated pursuant to a domestic enquiry made some time in 2011 and therefore, would not be a person, who could claim to be interested in terms of section 2(10) of Section 73-A of the Bombay Public Trusts Act, 1950.

The application for impleadment filed by the respondent No.2, itself indicates this position( page 18). The impugned order
also does not indicate as to how the presence of respondent No.2 would be conducive for the purpose of deciding the Change Enquiry Report.

Issue notice for final disposal, returnable on 26.08.2024. The learned AGP waives notice for respondent Nos.1 and 3. The petitioners to serve the respondent No.2 by all modes permissible in law.

By way of ad-interim order the effect and operation of the impugned order dated 27.05.2024 shall stand stayed till the returnable date.
