Heard Mr. Gadhavi, learned Advocate for Petitioners. 2.

The impugned orders are appended at page Nos.426 and

427. These orders dated 26.04.2024 are passed below Exhibits-5 and

208. Prima facie, learned Trial Court has recorded the fact that substantial time has passed after institution of suit in the year 2012 and therefore directed Exhibit-5 to be decided alongwith Suit. 3.

Even after the impugned orders were passed, almost two years have passed.

Mr. Gadhavi informs the Court that the Suit is at the stage of framing of issues.

In this view of the matter and without going into merits of the matter, it would be appropriate to direct learned Trial Court to determine the Suit as expeditiously as possible and it be decided in any

Server copy of this order shall be placed before learned Trial Court by Petitioner on 15.06.2026 at 11:00 a.m.. 7.

Learned Trial Court shall take cognizance and accordingly determine the Suit as per its convenience.

Needless to state that learned Trial Court shall not be influenced by any observations made in interlocutory orders. 9.

All contentions of both the parties are expressly kept open. 10.
