Heard Ms. Musale, learned counsel, for the petitioner and Mr. Patil, learned counsel representing respondent no. 1. 2.

Learned counsel representing respondent no. 1, on instructions received from the Chief Executive Officer of Nagar Parishad, Panchgani, District Satara, submits that the Nagar Parishad shall withdraw the work order and undertake the process of re-tendering. He, however, states that at the

905-WP.10458.2024 moment, respondent no. 4 is carrying out the subject work. He also submits that the re-tendering process shall be completed within two months and accordingly, respondent no. 4 may be allowed to carry on the work.

In view of the aforesaid, the writ petition has been rendered infructuous, which is hereby dismissed. 4.

However, we provide that till the re-tendering process is undertaken by respondent no. 1, the subject work shall be carried on by respondent no. 4.
