The learned counsel for the petitioners submits that the order appointing the Court Commissioner to measure the suit land is premature and the suit is at the stage of filing of written statement and some of the respondents have filed the written statement while some are yet to file the written statement. As such, the application filed by the defendants is pre-mature.

Issue notice to the sole respondent, returnable on 11.12.2024.

Until the next date, the impugned order dated 07.08.2024 would remain stayed.
