Heard learned counsel for the petitioner. In the light of the order dated 07/02/2024 passed by this Court in Writ Petition No. 15433 of 2023 [State of Maharashtra & Ors. Vs. Vikram Hona Shelke], without referring to the submissions made by learned counsel for the parties in detail, for the same reasons as given by Co-ordinate Bench, the impugned judgment of the Tribunal dated 23/08/2023 is quashed and set aside.

The proceedings are restored before the Tribunal for being decided afresh in accordance with law.

All points raised by either of the parties to be raised before the Tribunal.
