By the impugned order, the Appellate Court has dismissed the petitioner's appeal for non-prosecution. The petitioner has remedy of approaching the Appellate Court by filing an application for restoration. Hence, by keeping said remedy open to be adopted by the petitioner, the writ petition stands disposed of. 2.

It is made clear that this Court has not considered the merits of the matter.
