The learned counsel for the petitioner has today furnished affidavit-cum-undertaking submitted on behalf of the Proprietor of the petitioner's firm wherein undertaking has been given that all the amounts due and payable to the respondent no.1-Bank would be paid with interest within a period of six months from today. It is further stated that if the amount is not repaid, the petitioner would vacate the secured asset and handover peaceful possession of the flat to the Bank. The undertaking is taken on record and marked "A" for identification. The statements made are treated as 1/2

The statement made on behalf of the petitioner that amount of Rs.1,00,000/- would be deposited with the Bank tomorrow is also accepted.
