1] We have heard the learned counsel for the parties and we have perused the affidavit-in-reply on behalf of Zilla Parishad. The petitioners seek reimbursement of grants under the provisions of Section 12(2) of the Right of Children to Free and Compulsory Education Act, 2009. In the affidavit-in-reply filed on behalf of respondent no.2, it has been stated that the proposals submitted by the petitioners were duly examined and on 03/06/2024 the Education Officer (Primary) has forwarded the said proposal to the Director of Education (Primary). 2 21 WP-10862-2024.doc 2] The manner in which such reimbursement has to be undertaken is laid down in Section 12 of the Act of 2009. Considering the time line, it is directed that since the proposal in question is pending with the Director of Education since 03/06/2024, the grants which the petitioners are entitled to can be released expeditiously and in any event prior to 31/03/2025.
3] With the aforesaid directions, writ petitions are disposed of. 4] Learned counsel for the petitioners prays for grant of interest on account of the delay in releasing the amount of grants. For the present, said submission is merely recorded. In case the amounts in question are not released by 31/03/2025, the said prayer could be agitated. (M. M. SATHAYE, J.) (A. S. CHANDURKAR, J.)
