The limited request made on behalf of the petitioner is for direction to be issued to the Debts Recovery Appellate Tribunal to consider the application for waiver of pre-deposit that has been moved by the respondent nos.2-appellant before the Debts Recovery Appellate Tribunal. The petitioner as auction purchaser contends that the appellant is prejudiced as the respondent no.2 is delaying the consideration of this issue.

Since the proceedings are listed before the Debts Recovery Appellate Tribunal, it is directed that the waiver application be considered on its own merits and decided in accordance with law.
