The challenge raised in this writ petition is to the order dated 23rd July 2024 by which the Maharashtra Administrative Tribunal has directed the respondent no.1 to consider the claim of the respondent no.2 for promotion after opening the seal cover envelope. This order was necessitated in view of the fact that the claim of the respondent no.2 was not being considered. According to the petitioner, his claim for promotion also deserves consideration. The petitioner however admits that respondent no.2 is senior to the petitioner.

In view of this, the order dated 23rd July 2024 passed by the Maharashtra Administrative Tribunal in Original Application No.760 of 2024 does not give any cause of action to the petitioner to challenge the 1/2 Digitally signed by SNEHA ABHAY DIXIT Date:

said order. The petitioner is free to independently agitate his grievances based on his prayer for grant of promotion. The same can be done before the Maharashtra Administrative Tribunal. The writ petition is therefore dismissed.
