The challenge in this Writ Petition is to the Order dated 4th May 2023 passed by the learned Judge, Family Court No.6, Mumbai in Interim Application No.96 of 2021 in Petition No. A-1868 of 2020. 2.

At the outset, Ms. Kazi, learned Counsel appearing for the Petitioner, seeks withdrawal of the Writ Petition with liberty to file Review Petition before the learned Family Court. 3.

Accordingly, the Writ Petition is allowed to be withdrawn and disposed of as such with liberty to file appropriate proceeding seeking review of said order dated 4th May 2023 before the learned Judge, Family Court, Mumbai.

Needless to observe that the Petitioner will get benefit of Section 14 of the Limitation Act, 1963.

If such proceeding is filed seeking review, learned Judge, Family Court, Mumbai is requested to dispose of the said proceeding expeditiously.

It is clarified that this Court has not considered the merits of the said order dated 4th May 2023 and all contentions in that behalf are expressly kept open.

Accordingly, the Writ Petition is disposed of in above terms with no order as to costs.
