The petitioners claimed that their proposal for regularization is pending before the respondents, and yet, no decision has been taken. The respondent No.3/The Collector, District Jalgaon forwarded the proposal to respondent No.2/The Divisional Commissioner, Nashik Division, District Nashik vide covering letter dated 30.12.2022.

During the hearing, it was transpired that on 14.10.2024, the Joint Commissioner addressed a letter to the learned AGP, requesting him to solicit time in the matter. Thereafter, another letter of 15.10.2024 was placed on record, which discloses that the proposal is pending before the Hon'ble Chief Minister for further consideration.

The proposal of the petitioner has to be considered and decided by the respondent No.2/Divisional Commissioner, Nashik Division, District Nashik in consonance with the guidance solicited from the Hon'ble Chief Minister. In view of the correspondence placed on record, it appears that the matter is pending before the Hon'ble Chief Minister. 5.

Learned AGP informs that a further period of four months is required for finalizing the proposal of the petitioner. We, therefore, pass the following order:

ORDER

(i) The respondent No.2 shall take the decision regarding the proposal for regularization of the petitioners within four months from today, on its merit.

(ii) The respondent No.2/Divisional Commissioner can have concurrence or the guidance from the Hon'ble Chief Minister. (iii) Writ Petition is disposed of.
