Heard learned counsel for the petitioner and the learned State counsel.

By instituting this petition under Article 226 of the Constitution of India, though a prayer has been made to quash e-tender notice dated 22nd June 2024 issued inviting bids for mechanized cleaning services in hospitals and primary health care centers in the State of Maharashtra, however, learned counsel for the petitioner has very categorically stated that he has not challenged any of the tender conditions and in fact, the petitioner only seeks clarification from the tendering authority in respect of certain tender conditions which are vague and ambiguous.

We are afraid, we cannot entertain such petition unless the alleged ambiguous and vague tender conditions are challenged. The petitioner is said to have made some application seeking clarification of the tender conditions and also the manner in which the tender work is to be executed. All this lies in the realm of the tendering authority and as such, this petition, in the form it has been presented before us, cannot be entertained.

The writ petition is, thus dismissed.
