1.

This petition under Article 226 of the Constitution of India is filed praying for the following substantive reliefs:- "(b) The Respondent No.3 may be directed to comply the Order dated 31.12.2021 passed by the Respondent No.1 herein (Exh.H) immediately and the Respondent No.1 may be directed to take action against the Respondents No.2 and 3 as per section 20 of the Right to Information Act, 2005.

(c) The Respondents may be directed to comply the provisions of Right to Information Act, 2005 in its true spirit and on failure of the same, take action U/s. 20 of Act of 2005." 2.

We find that the grievance of the petitioner is in regard to the orders dated 31 December 2021 passed by the State Information Commission, Pune Division, Pune which, according to the petitioner are not complied. However, from the record, we find that a communication was issued by Pallavi Wargaonkar, PS

10-WP-11330-2024.doc the State Information Officer/Junior Engineer, P.W.D. Islampur to the petitioner to remain present before the said officer on 20 July 2023 and certain documents were issued to the petitioner. 3.

It appears to us that the petitioner was not satisfied with the said information and certain further documents as per the directions of the State Information Commissioner were required to be issued to the petitioner.

4.

In this view of the matter, we are of the opinion that as the order passed by the State Information Commissioner is dated 31 December 2021, it needs to be complied in all respects, as it is binding on the Public Information Officer, PWD of Islampur - respondent no.3. 5.

Let all these documents in compliance with the said orders be issued to the petitioner within a period of 6 weeks from today. Ordered accordingly.

6.

Keeping open all contentions of the parties, we dispose of this petition. No costs.
