1) Mr. Narvankar, the learned counsel appearing for the Petitioner submits that Second Appeal No.518/2024 also arise out of challenge to the common decree dated 2 August 2023 passed by the Trial Court in Special Civil Suit No.13/2020 and Civil Misc. Application No. 23/2017. Second Appeal is filed in respect of the decree passed in Special Civil Suit No.13/2020 whereas the present Writ Petition is filed in respect of the order passed in Civil Misc. Application No.23/2017. He would submit that steps would be taken for assignment of the Second Appeal and Revision Application before the same Court. Stand over to 30 September 2024.
