Learned counsel for the petitioners submits that this petition is filed only to the extent of challenge to the back-wages granted by the Tribunal to respondent No.1. It is his submission that pursuant to the order passed by the Tribunal, respondent No.1 has already resumed his duties. It is submitted that though back-wages are granted, it was the specific case of the petitioner before the Tribunal that the services of the respondent No.1 are not terminated and in fact, he is remaining absent voluntarily.
