We have heard the learned counsel for the parties for some time. Mr. Dighe Learned Counsel for the Municipal Corporation on instructions of Mr. Shekhar Gurav, Deputy Engineer, Water Supply Department. "H" Ward, Pune, who is present in the court submits that the Municipal Corporation shall issue an appropriate show cause notice to the petitioner calling upon the petitioner to show cause as to why the petitioner ought not to be black listed as its contractor in relation to the works in question and subject matter of the present petition. Thereafter, after granting an opportunity of the petitioner to file a reply and be Meera Jadhav

2/2 20-wp-11520-24.doc heard on its contentions, pass an appropriate order in accordance with law. At this stage, Mr. Dighe informs the court that a show cause notice shall be issued to the petitioner within a period of two weeks from today. Let the same be accordingly issued and be adjudicated in accordance with law. Considering the fair approach as taken on behalf of the Municipal Corporation, this petition can be disposed of in terms of the following order:

ORDER

(i) The impugned notice dated 2nd August 2024 blacklisting the petitioner is quashed and set aside with liberty to the Municipal Corporation to follow an appropriate lawful procedure as noted hereinabove.
