Learned counsel for the petitioner submits that considering the limited source of income of the petitioner, he is unable to pay an amount of Rs.5000/- as directed by the impugned order. However, according to the petitioner, he will be agreeable to pay an amount of Rs.2500/- towards interim maintenance.

Learned counsel further submits that the petitioner has complied with the directions in the impugned order by making payment of the first installment towards arrears of maintenance and he will continue to pay monthly maintenance of Rs.2500/- instead of the amount granted by RAJESHWARI RAMESH PILLAI Date:

7-WP-11582-2024.docx by the impugned order. Learned counsel for the petitioner further on instructions submits that the petitioner is agreeable to explore possibility of amicable settlement with the respondent. 3.

The respondent is permitted to withdraw the amount that is deposited by the petitioner in the Family Court. The amount should be paid to the respondent on production of authenticated copy of this order.

In view of the aforesaid statement, issue notice to the respondents returnable on 11th October 2024.

In addition to the court notice, learned Advocate for the petitioner shall serve the respondent by private service along with copy of this order and file service affidavit before the next date. 6.

Subject to compliance of the aforesaid statement, no coercive action to be taken against the petitioner for recovering arrears of maintenance as per the impugned order.
