Mr. Khaire, the learned Counsel for the Petitioner states that the Petitioner's land has been utilized for public purpose, however without acquisition. He submits that the legal issue would stand squarely covered by the decision of the co-ordinate Bench of this Court in Writ Petition No. 1540 of 2020 in the case of Shantaram Dinkar Saswde Thr. POA B. S. Saswade Vs. The State of Maharashtra Thr. The Principal Secretary & Ors. The copy of the said decision is furnished to the learned AGP.

Let Reply Affidavit be filed as also such position be considered by the appropriate Competent Authority of the State Government, and be placed on record in the reply affidavit which would be filed. 3.
