This petition is filed under Article 226 of the Constitution of India. The only relief that the petitioner is seeks a direction to the respondent - Maharashtra Industrial Development Corporation ("MIDC") to decide the representation/communication dated 29 September 2022, addressed by the petitioner to the respondent. It is by such representation that the petitioner is calling upon the respondent to decide on the allotment of the adjacent plot of land bearing no. PAP-R-640 to be utilized for industrial purposes, in favour of the petitioner.

In the above backdrop that, we have heard the learned counsel for the parties. There is no written opposition/reply from the respondent on Mayur Adane, PA

27-WP-11951-2024 (C) .doc record. Be that as it may, we are in agreement with the learned counsel for the petitioner to the effect that the representation dated 29 September 2022, addressed by the petitioner to respondent - MIDC ought to be decided by the MIDC.

In our view, the following order would serve the interest of justice.

ORDER

(i) The respondent - MIDC is directed to hear the petitioner and pass a reasoned order on their representation/communication dated 29 September 2022 in accordance with law within a period of six weeks from the date of this order is presented to the respondent - MIDC by the petitioner.

(ii) All rights and contentions of the parties are expressly kept open.

(iii) Writ Petition is disposed of in the above terms. (iv) Disposed of. No costs.
