Heard Mr. Ugle, learned Advocate for Petitioner in Review Petitions and for Respondent in Writ Petition No.12025 of 2024; Mr. Patil, learned AGP for Respondent Nos.1, 3, 4 and 5 and Mr. Kadam, learned Advocate for Respondent No.2.

At the outset, Mr. Kadam would submit that he needs to implead City and Industrial Development Corporation of Maharashtra (for short 'CIDCO') as party to the Writ Petition. Considering the fact that Review Petitions are filed with respect to order passed by this Court dated 01.08.2024, Review Petitioner is directed to implead CIDCO as party to the Petitions.

Subject to hearing CIDCO and difficulty and exigency expressed by Mr. Kadam further order will be passed in the Review Petitions after hearing objections from CIDCO. This Court clarifies that difficulty expressed by Mr. Kadam that Managing Committee of the

Society should not face any adverse consequences since names of Petitioners were not in the original list of members given to CIDCO shall be considered while passing appropriate orders regarding membership of the Review Petitioners.

In that view of the matter, CIDCO is directed to be impleaded as party to clarify its position. Necessary amendment is permitted to be carried out forthwith in the Writ Petition as well as all Review Petitions. Re-verification is dispensed with. Copy of this order alongwith copy of Petitions shall be served on CIDCO by both the learned Advocates.

CIDCO is directed to remain present on the next adjourned date and voice its objections if any regarding membership to be conferred upon Review Petitioners in accordance with the MCS Act, Rules and Bye laws so that Society's Management Committee is not faced with any difficulty.

Stand over to 29th July, 2025.
